CozyNCLEX Prep Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using CozyNCLEX Prep ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

CozyNCLEX Prep is a mobile application designed to help nursing students prepare for the NCLEX-RN and NCLEX-PN examinations through flashcards, quizzes, and practice tests.

3. Account Registration

To use CozyNCLEX Prep, you must:

• Create an account using email/password, Google Sign-In, or Apple Sign-In
• Provide accurate and complete registration information
• Be at least 17 years of age
• Maintain the security of your account credentials

You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

4. Subscriptions and Payments

Free and Premium Features

CozyNCLEX Prep offers both free features and premium features that require a subscription. Premium features include additional study modes and unlimited access to all content.

Subscription Terms

• Subscriptions are billed through your Apple ID account
• Payment is charged at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings
• No refunds are provided for partial subscription periods

Price Changes

We reserve the right to change subscription prices. Any price changes will apply to subsequent billing cycles, not the current period.

5. User Content

Your Content

You may create custom flashcards and notes within the App ("User Content"). You retain ownership of User Content you create. By using the App, you grant us a license to store, sync, and display your User Content to provide the service.

Content Guidelines

You agree not to create User Content that is:

• Illegal, harmful, or offensive
• Infringing on others' intellectual property rights
• Containing malware or harmful code

6. Intellectual Property

All content provided in the App—including questions, explanations, rationales, graphics, and software—is owned by CozyNCLEX Prep and protected by copyright law.

You may NOT:

• Copy, reproduce, or distribute App content
• Share screenshots of questions or answers publicly
• Use App content for commercial purposes
• Reverse engineer the App
• Share your account or subscription with others
• Use automated systems to access the App

7. Account Termination

By You

You may stop using the App at any time. To delete your account and data, contact us at the email below.

By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Share or redistribute App content
• Use the App in a way that harms other users or the service

8. Disclaimers

No Guarantee of Exam Success

While we strive to provide quality study materials, we make no guarantee that using this App will result in passing the NCLEX or any other examination. Exam success depends on many factors beyond this App.

"As Is" Service

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Accuracy or completeness of content
• Uninterrupted or error-free service

9. Limitation of Liability

To the maximum extent permitted by law, CozyNCLEX Prep shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of data or study progress
• Failure to pass any examination
• Any damages resulting from service interruptions

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with applicable U.S. law.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CozyNCLEX Prep regarding use of the App.
